Abstract

The article is devoted to the study of the place and role of information law in the legal system of Ukraine. The state of development of this topic is analyzed with references to the scientific work of legal scholars who studied the legal system of Ukraine from the standpoint of presenting the axiological meaning of information law. The provisions of certain articles of the Constitution of Ukraine, which guarantee the possibility of lawfully possessing, using and distributing information, are given, and the official definition of the term «information» is given in accordance with the interpretation of this concept in the Law of Ukraine «On Information».

In order to present the appropriate level of research into the legal nature of the relatively young field of law, which is information law, a study of the logical and legal connections between the concepts of «information» and «law» was carried out, with an emphasis on ensuring the lawful use of information in combination with recommendatory and imperative prescriptions rules of conduct reduced to mandatory compliance by all representatives of civil society. The author's understanding of the role and importance of information law in the conditions of repelling a racist attack is presented, attention is focused on ensuring an appropriate level of information security, namely effective counteraction to any manifestations of hostile and unfriendly actions in the field of information use, regardless of the country of origin.

On the basis of the analyzed scientific work, with references to the conclusions of both individual scientists and to the collective studies of representatives of various scientific schools in the field of information law and information security, the interdisciplinary nature of information law has been proven through the prism of evaluating its role in ensuring communication between different branches of law. It is assumed that such ability is acquired due to its internal structure, the functioning of the internal elements of the integral mechanism, namely the ability to create a legal environment for the legitimate transfer of information.

Scientific approaches to understanding the concept of «information law» are analyzed, the author's vision of the legal nature of normative regulation of relations between members of society when using, collecting and disseminating information about oneself or other citizens, events or environmental phenomena is expressed.
