DYNAMICS OF THE CONTENT OF PRIVATE (INVESTIGATION) AND LAW ENFORCEMENT ACTIVITIES

Abstract

Abstact. The scientific article explores and presents the definition of the essence and characteristics of private detective activity in Ukraine, the classification of detective and law enforcement activities, and the legal status of private detectives in Ukraine. An analysis of theoretical aspects and legislative regulation of the organizational foundations of the actions of private detectives when providing assistance in detective activities. There is a gap in Ukrainian legislation on this issue; it has not defined the legal status of an individual engaged in private detective activity (private detective); special grounds and conditions for licensing the relevant activity; the procedure for formation and statutory requirements for legal entities specializing in private detective activity. The dynamics of the content of private (detective) and law enforcement activities is an important aspect that requires in-depth analysis in the context of modern social, economic, and legal realities. Ensuring a balance between private interests and public needs, as well as legal protection of all participants in this process, remains the main tasks for legislators, researchers, and practitioners in this area. The analysis of this and other problems of various natures related to the collection and use of physical evidence by a person engaged in private detective activities is given attention in our article. It is also important to create an effective system of interaction between private detectives and law enforcement agencies, which will contribute not only to increasing the efficiency of investigations but also to strengthening citizens’ trust in the justice system.
