ESSENCE, CONCEPT AND CONTENT OF POST-WAR RECOVERY: THEORETICAL AND LEGAL ASPECT

Abstract

The paper highlights the etymology of the concept of «post-war state recovery». It is revealed that the interpretation of the concept of ‘post war state recovery’ is absent in the theoretical and legal framework, which in fact results in a serious gap in the national science. The crucial point here is that this term has not been introduced to the legislation. Yet, theoretical scientists have not reached a common ground concerning the understanding and revealing the essence of the given concept. The authors suppose considering the term «post-war state recovery» as a complex of organizational, legal, financial, and other measures aimed at accelerating reconstruction and establishing conditions to improve the live of the population and the activities of economic entities in a certain territory in order to overcome the consequences of war, including humanitarian, social, economic, and others. The paper considers theoretical approaches to understanding the definitions of «post-war recovery» and «post-war reconstruction». It is determined that despite the fact the terms «post-war recovery» and «post-war reconstruction» are closely interrelated, in fact they are not identical. From how we have interpreted this, the concept of post war recovery deals with much broader scope and aimed at not solely restoring of what has been destroyed or damaged due to war, but first and foremost at state development. Post-war state recovery, unlike reconstruction, includes the restoration of both material and №n-material objects, such as such as social institutions, №rms and social values. Essence, concept and content of post-war state recovery are investigated from the perspective of theoretical and legal aspect. The authors view the essence of the post-war state recovery as a set of measures aimed at restoring sovereignty and territorial integrity, economic potential, political system and the state’s social sphere, which have been destroyed or damaged due to the war. That is to say, it is a comprehensive process that is to occur after the end of the war, aiming at the restoration and further development of the state, which comprises many stages and should encompass planning for short-term, medium-term, and long-term perspectives as much as possible.The article emphasizes the main tasks which the state is supposed to confront in the post-war period.
