Abstract

In the proposed article, the authors continue to consider the issue of artificial intelligence in relation to the protection of human rights and freedoms during the election process. It has been established that the use of artificial intelligence technologies is aimed at protecting human rights to dignity as a basic and fundamental right of a person, primordial for all other rights and freedoms, and the violation of any rights in this way can be considered a violation of the right to human dignity. 

It is justified that the occurrence of threats to human rights in one form or another when using artificial intelligence requires finding ways to overcome risks and threats to human rights and the proper functioning of the human rights protection and rights restoration mechanism. 

The work thoroughly covers the impact of artificial intelligence on the implementation of the right to vote in Ukraine and foreign countries. A system of scientific research methods and information processing algorithms is used, which have a significant impact on the realization of human and citizen rights and freedoms in Ukraine. The current state of legal protection of human rights and freedoms in Ukraine has been analyzed, normative documents that need to be revised have been established. It has been proven that the following rights and freedoms are under particular threat due to the influence of artificial intelligence, in particular, freedom of expression, the right to freedom of movement, the right to freedom and fair elections, the right to a fair trial, and the right to respect for private and family life. It was noted that Ukraine does not stand aside from the processes of improving the legal regulation of artificial intelligence technologies and expresses its desire to occupy a significant segment of the world market of artificial intelligence technologies, leading positions in international rankings. Artificial intelligence technologies are expected to contribute to the transformation of the economy, the labor market, government institutions and society in general. Their application will provide an opportunity to reduce costs and increase production efficiency, quality of goods and services. It has been proven that according to the preamble to the "Convention for the Protection of Human Rights and Fundamental Freedoms" dated March 20, 1952, basic human rights and freedoms are best ensured "through effective political democracy." 

Articles of the International Covenant on Civil and Political Rights were analyzed, where every citizen without any discrimination and without unreasonable restrictions should have the right and opportunity to participate in public affairs both directly and through elected representatives. 

It is proven that the voting process and the process of automatic counting of votes is provided exclusively with the help of electronic devices and special software.
