PREVENTION OF CONFLICT OF INTEREST IN PUBLIC ADMINISTRATION: GENERAL THEORETICAL ASPECT

Conflict of interest is analysed as a legal phenomenon arising from contradictions between the private interests of employees and their public powers. Thus, effective conflict management systems are the basis for the proper functioning of the civil service and the prevention of corruption in public administration.
The main types of conflicts of interest, potential and real, their differences and specifics in legal regulation are identified and analysed. Potential conflicts are characterised by the presence of private interests within the scope of official powers, which may influence the objectivity of decision-making, while real conflicts exist under the actual influence of private interests on the performance of official duties. The elements or components that make up a conflict of interest situation are described: the existence of official powers; the existence of private interests; the conflict between them.
The duties of officials regarding the implementation of measures to prevent the emergence and development of conflicts of interest, timely notification of their immediate supervisor of its existence, and actions under the actual conditions of the NACP to actively promote the resolution of the conflict are outlined. The role of the National Agency for Corruption Prevention in providing explanations regarding the existence or absence of conflict situations and determining the procedure for their resolution is outlined. Officials are subject to administrative, disciplinary and criminal liability for violations of the legislation on conflicts of interest.
Both the personal responsibility of the employee and the personal responsibility of his or her supervisor for the proper resolution of the conflict situation are defined. The prevention and resolution of conflicts of interest is a complex legal institution focused on integrity in public service and an objective process of management decision-making, which increases the level of public trust in government bodies.
