INTERNATIONAL LEGAL STANDARDS OF FREEDOM OF INFORMATION AND THEIR APPLICATION IN EMERGENCY SITUATIONS

The article analyzes international legal standards of freedom of information and the peculiarities of their application in emergency situations, particularly during martial law in Ukraine. It is emphasized that freedom of information is a cornerstone of democratic governance and a fundamental human right ensuring transparency, accountability, and citizens’ trust in state institutions. Under the conditions of martial law, the state faces the challenge of maintaining a balance between safeguarding national security and upholding the public’s right to access socially significant information. Based on the analysis of the Johannesburg, Siracusa, and Paris Principles, as well as international and national legal acts, the study substantiates that any restriction on the right to information must be lawful, pursue a legitimate aim, and be necessary in a democratic society.
The paper presents a comparative analysis of international and national regulations governing access to information, taking into account the practices of the Council of Europe, OSCE, UNESCO, and the European Court of Human Rights. It also examines Ukraine’s strategic policy documents in the field of information and state security – the Strategy for Ensuring State Security (Presidential Decree No. 56/2022) and the Strategy for Information Security (Presidential Decree No. 685/2021). Empirical analysis of data from 2022–2024 demonstrates a gradual increase in openness of public authorities despite wartime conditions. The research proposes conceptual directions for improving legal mechanisms of information freedom, including harmonization of restriction procedures, implementation of proportionality assessment standards, and strengthening judicial oversight.
The scientific novelty lies in the systematic approach to defining theoretical and legal foundations of freedom of information during emergencies and in substantiating the need for deeper integration of international norms into Ukraine’s legal framework. The practical significance of the study consists in the potential use of its findings in lawmaking, governance, and educational programs in the field of human rights and international law.
