THE STATE AND PROSPECTS OF LEGAL REGULATION OF E-COMMERCE IN UKRAINE

The article is devoted to the study of the current state and prospects of the legal regulation of e-commerce in Ukraine in the context of globalization processes and European integration challenges. Attention is focused on the fact that e-commerce is a complex legal phenomenon regulated at the intersection of general and special norms of various branches of law. The paper analyzes the main legal acts governing this field, including the Constitution of Ukraine, the Civil Code of Ukraine, the Commercial Code of Ukraine, and the Law of Ukraine "On Electronic Commerce".
The article emphasizes existing gaps in the current legislation, particularly regarding the protection of personal data, which creates risks for user rights and contradicts international standards. Special attention is paid to the experience of the European Union, particularly the implementation of the General Data Protection Regulation (GDPR), which ensures transparency in data processing, minimization of data collection, and the realization of the right of users to have their data deleted.
In addition, the article addresses key issues related to the functioning of payment systems, which serve as the foundation for transactions in the field of e-commerce. The lack of appropriate legal regulation of transactions involving virtual assets (cryptocurrencies) is noted, which creates legal uncertainty and contributes to the development of the shadow economy. The article underscores the necessity of harmonizing national legislation with European standards, which will contribute to improving the efficiency of e-commerce, protecting user rights, and integrating Ukraine into the global digital market.
