THEORETICAL APPROACHES TO THE DETERMINATION OF THE EXTERNAL FUNCTIONS OF THE STATE IN UKRAINE AND HUNGARY: A COMPARATIVE LEGAL ANALYSIS

Abstract

The functioning of the state is a rather complex and dynamic process that requires theoretical understanding. This causes considerable effort and serious disagreement among scientists. In the process of research, it is relevant to consider the functions of the state in the philosophical-legal system of the conceptual provisions of the state-legal theory, theoretical approaches, what are the definitions of the functions of the state, what are the components and whether they cooperate with each other. This is determined by the objective conditions and laws of social development. But this direction is of particular importance for Ukraine, which is currently at the stage of a sharp renewal of social spheres of life, including the state and legal sphere. Therefore, the issue of ensuring, protecting, regulating, and guaranteeing social and individual interests is the main goal of the state as a socio-legal entity. Therefore, all attention is focused on the regulation of socially important spheres. Such directions in the theory of the state and law of Ukraine are traditionally called the functions of the state, which according to different definitions and approaches of experts both in Ukraine and in Hungary can be interpreted as the main directions of activity. Today, the scientific literature contains different opinions about which constituent elements are those functions and according to which criteria to classify them. The most widespread, although not final, classification is the division into external and internal functions, this is the opinion held by Ukrainian and Hungarian specialists. With this scientific work, we will try to demonstrate different views of Ukrainian and Hungarian specialists with the aim of expanding scientific research through comparative legal aspects.
