THE FUNCTIONING OF LOCAL SELF-GOVERNMENT BODIES DURING THE LEGAL REGIME OF MARTIAL LAW IN THE CITY OF KYIV

Abstract

The scientific article is devoted to the issue of the functioning of local self-government bodies during the legal regime of martial law in the city of Kyiv, defines the bodies that, according to the current legislation of Ukraine, should be considered as local self-government bodies in the territory of the city of Kyiv, and also it describes the peculiarities of regulatory and functional changes in the work of the latter through the introduction of the legal regime of martial law on the territory of Ukraine from February 24, 2022. In addition, the article contains an analysis of the powers of local self-government bodies before the introduction of the legal regime of martial law on the territory of Ukraine and after the introduction of the legal regime of martial law on the example of the capital of Ukraine - the city of Kyiv. The scientific article analyzes the provisions of the main laws in Ukraine, which regulate legal relations with local self-government bodies in Ukraine, determine the powers and competence of local self-government bodies, and determine the features of the special status of local self-government bodies operating in the city of Kyiv. The scientific article also analyzes the provisions of the main subordinate regulatory legal acts, in particular, of local self-government bodies operating in the city of Kyiv, which regulate legal relations in the relevant local self-government bodies, determine the powers and competence of these local self-government bodies, and defines the features of the special status of the Kyiv City Military Administration , Kyiv City State Administration and Kyiv City Council. A set of problems that have arisen in the functioning of local self-government bodies of the city of Kyiv have been studied and options for solving the relevant problems have been proposed. The scientific article contains an analysis of the positions of scientists in the field of functioning, formation and development of local self-government bodies in Ukraine. It was highlighted that the features of the special status of the capital of Ukraine - the city of Kyiv, defined by current legislation and applied, in particular, to local self-government bodies in the capital of Ukraine, are insufficiently regulated by legislation and are subject to revision.
