INDIVIDUALIZATION OF THE PERSON IN THE CONDITIONS OF INFORMATION SOCIETY

Abstract

The article deals with the individualization of individuals on a more extensive basis. The author proceeds from the fact that in the information society the possibility of anonymous participation in civil legal relations is gradually narrowing. He presents the system of means of individualization of the person developed by him and the formed concept of their reflection in the updated Civil code of Ukraine. The author divided such means of individualization into biometric, age, household, psychological-property, corporate, professional, business, religious, and others. At present, they are integrated thanks to IT law, and when recoding civil law, there is a need to change the approach to them and ensure the right to receive information about a person in general and a possible participant in legal relations in particular. It is indicated that individualizing features can be permanent or variable (place of residence), as well as direct and indirect. By origin, they are legal and provided by applicable law and private - elected by the individuals themselves, or assigned to other individuals. The design of integrated means of individualization based on chips has been introduced, which will contain all or most of the means of individualization of a person, which he needs to exercise proper rights and perform legal duties. This serves to complete the acquisition of information about the person and the security of entering into a legal relationship with him. A holistic concept of personalization of participants in legal relations as an intersectoral, suitable for use in private and public law and will serve to ensure the safety of participation in them and increase the responsibility of individuals in the exercise of their subjective rights and legal obligations. The proposed proposals and conclusions can be used to improve the individualization of individuals as participants in civil and other legal relations. It is proposed in the Central Committee of Ukraine to allocate a special paragraph on individualization and would cover the rules of definition, disclosure of the content of certain means of individualization, cases and procedures for their use, protection in case of violation of rights to such means
