Features of becoming private detective activity in Ukraine in comrarison with foreign countries

Abstract

The article deals with some problematic issues regarding the legalization of private detective activity in Ukraine. Existing legislative drafts designed to legalize private detective activity in Ukraine are researched. Particular attention was paid to the necessity of legal regulation of private detective activity. Private detective activity in law enforcement practice at the present stage of becoming Ukraine as a modern European state is one of the tasks, the solution of which will promote the realization of human rights to life, health, protection and inviolability of legal rights, freedoms, interests, and privacy. Therefore, the question of obtaining a quality, legally regulated detective service is essential, since in Ukraine private detective activity is not still at the
appropriate legal level. In most countries of the world, where this type of activity is recognized at the national level, it is common, sustainable, and sufficiently standardized by national law. To understand the demand for instituting private detective activity in Ukraine, it’s necessary to refer to the existing draft laws and publications about the formation of new detective agencies, the history of developments in foreign countries, and legal legalization. One of the important elements of law enforcement activities is strong cooperation with the active segment of the population. Providing effective public order safety, protection of rights and freedoms, as well as interests guaranteed by the Constitution of Ukraine is impossible without the involvement of citizens interested in security. In the realm of the integration of Ukraine and the European Union, domestic legislation must ensure respect for the constitutional rights and freedoms of an individual and a citizen, which is why both public authorities and society shall unite to ensure the rule of law and to set up an institute of private detectives. This article is devoted to the relevance of the study of the issues connected with the setting up an institute of private detectives in Ukraine.
