The current state of the system of land legislation of Ukraine and its development in the conditions of European integration

Abstract

The article deals with the current state of the system of land legislation of Ukraine and its development in the conditions of European integration. The constitution of Ukraine affirmed “the European identity of the Ukrainian people and the irreversibility of the European and Euro-Atlantic course of Ukraine”, gave the corresponding powers to the Verkhovna Rada of
Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine regarding the European and Euro-Atlantic course of Ukraine. That is, the vectors of European integration are directly attributed to the executive and legislative bodies of the state power of Ukraine by the basic law of Ukraine. Attention is drawn to the significant inertia in the processes of implementation and practical implementation of changes on the path to European integration mentioned above by the legislative and executive bodies of Ukraine. The definition of the term “system” is investigated; “Systems of legislation” and its constituent elements. Attention is drawn to the fact that the concept of “land law” can have a dual meaning: it means either a set of laws (“narrow” understanding) or a set of laws and other regulations (“broad” understanding). The current state of the system of land legislation of Ukraine, in the context of filling the normative legal acts, makes it noteworthy its great structure. The rules governing land relations are scattered over hundreds of legal acts. This potentially leads to a large number of collisions. It is emphasized on the inadmissibility of collisions in the land legislation of Ukraine. It should also be noted that the urgency and timeliness of the issues raised are to emphasize the change in the approach to the problem of classification of normative legal acts of land legislation as the primary source of systematization and creation of a transparent system of land legislation, which in turn will allow to improve and approximate bilateral exchange of experience and results of lawmaking, both between the legislative and executive bodies and for all citizens of Ukraine. The need for a comprehensive approach, taking into account the aspirations of society and historical traditions for the successful implementation of land reform was emphasized.
